§ 1. Introduction
1. The purpose of these Terms and Conditions is to set forth the terms and conditions for providing services with the use of No Fluff Jobs, an online job board operated under a domain name www.pmvalley.com (“Job Board”) pursuant to the Act of July 18, 2002 on Rendering Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną).
2. The scope of services provided by the Job Board includes (i) receiving job advertisements, (ii) preparing job advertisements for publication, (iii) publishing job advertisements, (iv) receiving job applications from Candidates, (v) forwarding job applications to Advertisers and (viii) ancillary services.
3. A prerequisite for using the services of the Job Board is to agree to be bound by the provisions of the Regulations. Upon the acceptance of these Regulations, there is a legally binding Agreement between the Job Board and the Advertiser. Such consent may be expressed only by the Advertiser ot a person authorized by the Advertiser to conclude yhe Agreement on his behalf and for his benefit.
4. The services of (i) receiving job applications, (ii) forwarding job applications and (iii) redirecting Candidates to the Advertiser’s online form and (iv) Candidate’s account are provided for the Candidate pursuant to the Art. 393 of the Civil Code.

6. The content of the Job Board creates a database of job advertisements (hereinafter: the database) subject to protection resulting from the Act of 27 July 2001 on the protection of databases.

§ 2. General Rules
1. The necessary condition to use the Job Board, including the use of the database the Job Board provides, is to agree to be bound by these Terms and Conditions.
2. Job advertisements on the Job Board are available for registered users and thus everybody can view their content free of charge. Viewing the job advertisements does not create legal relationship between the Job Board and a third person.
3. The sole purpose of the Job Board is to publish job advertisements, reply to job advertisements and to provide ancillary services. It is forbidden to use the Job Board for other purposes, especially for advertising other websites, products or services.
4. The Job Board does not provide services to anonymous entities or entities using nicknames only, which is justified by the nature of the provided services for which personal identification is substantial.
5. The Job Board has implemented a privacy policy and a personal data protection policy that is defined in a separate document entitled Privacy Policy.
6. Unless the Terms and Conditions state otherwise, it is prohibited to download or re-use any part of the database provided by the Job Board for any purpose.
7. Repeated or systematic downloading or re-publishing on the Internet and other telecommunications or computer networks of data provided by the Job Board that constitutes the database, in particular individual job advertisements, is prohibited.
8. Correspondence and notifications sent to the e-mail addresses indicated in the Registration Form or additionally indicated as contact addresses are considered delivered at the latest upon the receipt of such a message by the recipient's postal system.

§ 3. Advertiser
1. Advertiser is a natural person, legal person or an organization unit that is not a legal person conducting business activity that wants to employ an employee and publishes a job advertisement on the Job Board or sets up an Advertiser Account. Services provided to an Advertiser are subject to payment.
2. The Service provided for the Advertiser is composed of the following elements: maintaining the Advertiser’s account, taking over advertisements for jobs, preparing the above ads for publishing, publishing the ads, on behalf of the Advertiser receiving applications for job , transferring the above applications to the Advertiser, dissemination of the received applications in the framework of the Advertiser’s account by a period of 5 or 7 weeks from a date of submitting such applications (at a later stage the applications shall be automatically deleted), redirecting applications of Recipients of the advertisements to Advertiser, and finally publishing the Profile.
3. The services for the Advertiser are provided with or without a use of an account.

§ 4. Advertiser Account – Advertiser
1. An Advertiser is entitled to set up an Advertiser Account. An Advertiser may have only one Advertiser Account with a given email address. Setting up, using and deleting the Advertiser Account is free of charge.
2. An Advertiser Account is set up after filling in the on-line registration form: https://pmvalley.com/pracodawca/rejestracja/.
3. Only a person that is authorised to represent the Advertiser in the matter of recruiting new employees can make a request of creating an account.
4. Logging to the Advertiser Account is performed with the use of login and password.
5. Advertiser Account allows editing the existing job advertisements, monitoring the history of published job advertisements and monitoring received applications (after enabling that function on Job Board).
6. An Advertiser can delete the Advertiser Account at any time by making an appropriate
request by sending an email to the address specified in § 1 point 5 of the Terms and Conditions. Deletion of the Advertiser Account will take place within 24 working hours from making a request.
7. The Job Board may delete an Advertiser Account if the Advertiser does not log in or does not post any job advertisements within the timeframe of two years. The Job Board shall notify the Advertiser via email about the planned deletion of the Advertiser Account 14 days prior to deletion.
8. The Job Board may delete an Advertiser Account if the Advertiser fails to comply with theprovisions of these Terms and Conditions or with the provisions of law. The Job Board shallsend the Advertiser a warning via email not later than three days before deleting the Advertiser Account.
9. The Advertiser is entitled to create in the Account their Profile accessible to all Clients of the Website.
10. The Profile comprises the Advertiser’s identification data and job advertisements, as well asthe section that can be edited by the Advertiser. The information provided in the Profile should be in Polish or English, as well as complete, authentic, non-discriminatory, and non-misleading. It is prohibited to provide in the Profile any information of sexual nature. The Website is entitled to remove linguistic errors in the Profile, particularly spelling and grammatical ones.

§ 5. Posting and Submitting a Job Advertisement – Advertiser
1. Only a person that is authorised to represent the Advertiser in the matter of recruiting newemployees may fill out the form.
2. It is forbidden to fill out and submit job advertisement forms with the use of bots or other automatic programmes for sending emails.
3. A job advertisement is published through filling out and submitting a job advertisement form or by sending the request to: joboffers@pmvalley.com. The job advertisement forms shall be filled out with data describing the advertised vacancy. In case of publishing a job advertisement with joboffers@pmvalley.com the Advertiser’s data shall be given. All boxes in the form marked as obligatory shall be filled out.
4. Advertiser can additionally order a job advertisement refreshment thanks to which a job advertisement will appear once on the first position of the listing after 15 days or will appear twice after 10 and 20 days or will appear three times after 10, 20 and 30 days from the publication date.
5. After filing out the form submitting it and executing the payment an Advertiser shall receive a confirmation email with link to the job advertisement.
6. A job advertisement is published on the Job Board immediately after executing the payment not later than 24 working hours after executing the payment. Publishing a job advertisement is performed in an automatic way.
7. Advertiser consents to the sending of the electronic VAT Invoices to the e-mail address provided during registration.
8. A job advertisement is available online for the period of 30 or 45 consecutive days from the publication date. After 30 or 45 days the job advertisement shall be deleted from the Job Board and the Job Board shall not receive new applications to this job advertisement. A new job advertisement is always published on the first position of the listing in a given category, and after a new job advertisement has been posted, it will take position below.
9. In order to continue the publication of the job advertisement and Advertiser shall post a job advertisement with the same content.
10. The Job Board provides for Candidates an opportunity to send application form. After a Candidate has sent an application for job offer, the application shall be automatically forwarded to the Advertiser’s email address. The Job Board shall keep the application stored no longer than 5 or 7weeks from the date of submitting the application by the Candidate. A back-up copy of the application shall be stored for the period of 365 days from submitting the application by the Candidate.
11.The Job Board is entitled to publish a job advertisement in full or in part as an excerpt on other websites, discussion groups, mailing lists and others in order to promote a job advertisement.

§ 6. Job Advertisement – Advertiser
1. A job advertisement shall present a paid job offer for a natural person conducting business activity or not. The job advertisement can describe any legal form of employment; in particular on the basis of permanent contracts or fee-for-task agreements.
2. A job advertisement shall be prepared in English or Polish.
3. A job advertisement shall present a real job offer. It is forbidden to post non-existing job offers.
4. The position presented in a job advertisement and the conditions of work shall be lawful.
5. A job advertisement must not be in opposition with the law; especially a job advertisement must present a legal form of employment.
6. Information and other materials included in a job advertisement shall be complete, real, proper non-discriminating and not misleading. It is forbidden to post job advertisements of a sexual character.
7. A job advertisement shall include a precise salary, which means an exact salary amount or a salary range from X to Y.
8. The salary quoted in the job advertisement shall be adequate to the advertised position.
9. The Job Board is entitled to remove linguistic errors in the published job advertisement; especially grammar and spelling mistakes.
10.An Advertiser can demand receiving the following information from the Candidate:
a. name (s), surname,
b. parents’ names,
c. date of birth,
d. address (mailing address),
e. education,
f. professional experience,
g. other personal data, if revealing them is necessary because of making use of special rights defined in the employment legislation,
h. PESEL number.
11. An Advertiser cannot demand receiving the following information from the Candidate:
a. racial or ethnic ancestry,
b. political, religious or philosophical views,
c. religious or political belonging,
d. state of health, genetic code, addictions or sexual life.
12. The Job Board allows changing the job advertisement content that does not change the core information of the job advertisement such as personal requirements or technologies used in the project. Changes in a job advertisement after posting it may be made via email joboffers@pmvalley.com.
13. It is not allowed to make changes in the job advertisement that aim at amending:
a. the Advertiser offering a vacancy into a different entity,
b. workplace location,
c. main responsibilities of the employee,
d. job title,
e. job advertisement title.

§ 7. Advertiser – Personal data processing
1. The Advertiser is an administrator of personal data of the Ads Recipients, namely the candidates, who have submitted applications for jobs enclosed and used the available advertisement form.
2. The Service contains functionalities which simplify performance of the above mentioned obligation, it means automatic generating the informative obligation contents with an option allowing to edit thereof, providing also a simple and intuitive edition of the consent clauses’ contents, included below the recruitment advertisement form.
3. The Service undertakes processing of the entrusted personal data only within a range and aim necessary to provide the Advertiser with the service, specified in § 1 item 2 of the Set f Rules.
4. The Service ensures that the persons authorized by the Service to process personal data has committed to preserve secret or/and they are subject to respective statutory obligation of confidentiality.
5. The Service shall implement specific technical and organizational measures to ensure a level of security in the entrusted personal data processing, to comply with a risk of infringement of the individuals rights or freedom, taking into consideration the state of technical knowledge, cost of implementation and the character, scope, context and purpose of processing, especially the following:
a. Pseudonymisation and encrypting of personal data,
b. Capability of ensuring continuous confidentiality, integrity, accessibility and resilience of the processing systems and services,
c. Capability of immediate recovery of personal data accessibility and the access to in case of any physical and technical incident occurrence,
d. Regular testing, measuring and evaluating effectiveness of technical and organizational measures, assigned to ensure security of processing.
6. The Service shall undertake efforts to ensure for any individual, authorized by the Administrator or Processing Entity, who has an access to the entrusted personal data, to process the data only within the scope and purpose which are necessary to provide for the Advertiser the service defined in § 1 item 2 of the Set of Rules except where it is required according to the Union law or Member State’s law.
7. The Service makes commitment to support the Administrator on fulfilling the obligations defined in items 32–36 of GDPR.
8. The Service shall make accessible to the Administrator any information necessary to prove that the obligations defined in GDPR are fulfilled and shall enable the Administrator, or the Auditor authorized by the Administrator, to perform audits including inspections, and shall contribute thereto.
9. The Service shall immediately notify the Administrator if according to the Service opinion, the given instruction is an infringement to GDPR or other regulations referring to data protection.
10. Any decisions concerning processing the personal data, deviating from the provisions included in this Set of Rules, in order to be valid, should be reported to the other Party in writing.
11. The Service shall ensure implementation of technical and organizational measures suitable for processing, to fulfil requirements of GPDR and to protect the rights of persons, whom the data refer to, through, in particular:
a. Using the technical and organizational measures which guarantee protection for the personal data under processing, including protection of the data against making them available to unauthorised persons, taking by an unauthorized person, damage or destruction,
b. Permitting only the persons having the authorization issued by the Service to process the personal data, including operating the IT system and the equipment forming its part and assigned to process the data,
c. Ensuring control over data processing correctness,
d. Keeping of records of any persons authorized to process personal data,
e. Exercising special diligence to ensure that the persons authorised to process the entrusted personal data shall keep thereof in secrecy, also after completion of the data processing through, among the others, notifying them about legal consequences of violation of the data confidentiality and taking from them declarations concerning the non-disclosure of the above data.
12. The Parties agree that in course of processing the entrusted personal data they shall closely cooperate through the persons designated to contact, specially through Data Protection Inspectors, and shall notify each other about any circumstances which affect or may affect performance of the entrusted personal data processing.
13. After completion of service work the Service – up to the Administrator’s decision – shall delete or return thereto all the personal data, all the existing copies and is obliged to undertake any applicable actions to eliminate any possibility of further processing the entrusted data.
14. The Administrator’s decision concerning an intended use of the entrusted data should be communicated to the Service within 5 working days from providing services completion time.
15. The Service is obliged to relief of an entire damage suffered by the Administrator by way of default or improper performance by the Service of the obligations, defined in the Set of Rules, in particular by way of processing the entrusted data with infringement of the provisions of the Set of Rules or GDPR.

§ 8. Advertiser – Price of the Service
1. For using the services of the Job Board the Advertiser shall pay a price according to the Price List (Appendix no. 1 to these Terms and Conditions).
2. The Advertiser grants the Service a non-exclusive licence to use the trade names, graphic and verbal signs (hereinafter: works) specified in the advertisement, account or Profile in order to provide the service, for marketing purposes and for the purpose of publishing references. The principles of publishing references are specified in § 19 of the Terms and Conditions.
3. The basic price of the service is a price per one job advertisement that includes only one job offer.
4. The quoted price is a net price in PLN or in USD. In the case of a price in USD, the payment has to be made in USD only. The Job Board is an active VAT payer.
5. It is necessary to pay the price to be able to publish a job advertisement on the Job Board.
6. The payment may be performed via bank transfer to Job Board’s bank account.
7. Should the Adviser express their will not to publish a job advertisement or to delete a job advertisement earlier than after 30 days from the publication date, the Advertiser is not entitled to receive a reimbursement or price reduction.
8. fter executing the payment the Job Board shall generate an invoice and send it in a pdf format within 72 working hours from the purchase date to the Advertiser’s email address.
9. An Advertiser who is registered for VAT purposes in an EU country different than Poland is obliged to fill out a valid and correct individual VAT identification number that can be verified in the VIES system or state that they do not have an individual VAT identification number. If the given VAT identification number is invalid, incorrect or cannot be verified in the VIES system, the Job Board has a right to immediately remove the job advertisement from the website and demand that the Advertiser provides a valid and correct individual VAT identification number that can be verified in the VIES system. Removing the job advertisement was due to Advertiser’s fault. If the Advertiser provides a valid and correct individual VAT identification number that can be verified in the VIES system or pays the Job Board the remaining part of the price due (the Polish VAT rate for inland transactions) within 14 days from receiving the above mentioned demand, the job advertisement shall be published again on the website for the remaining part of the emission period.
10. An Advertiser who is conducting business activity outside the EU is obliged to fill out a valid, correct and verifiable VAT identification number or a similar number that enables
business identification given to them by the country where the Advertisers’ seat is registered or state that they do not have a VAT identification number. If the given VAT identification number is invalid, incorrect or unverifiable, the Job Board has a right to immediately remove the job advertisement from the website and demand that the Advertiser provides a valid, correct and verifiable VAT identification number. Removing the job advertisement was due to Advertiser’s fault. If the Advertiser provides a valid, correct and verifiable VAT identification number or pays the Job Board the remaining part of the price due (the Polish VAT rate for inland transactions) within 14 days from receiving the above mentioned demand, the job advertisement shall be published again on the website for the remaining part of the emission period.

§ 9. Copyrights – Advertiser
1. The Advertiser declares that:
a. the job advertisement and the Profile does not breach the rights of third persons; especially the copyrights or personal goods of the third persons,
b. they are in possession of the suitable proprietary copyrights of the trademarks and graphic symbols and word marks mentioned in the job advertisement, in the Profile or in the Advertiser Account.
2. The Advertiser grants the Job Board a non-exclusive license to use their trademarks and graphic symbols and word marks (“Work”) quoted in the job advertisement, in the Advertiser Account or in the Profile to perform the service.
3. The license is granted for a specified period of time that is for the time of providing the service or during the existence of the Advertiser Account. The Job Board may grant a sublicense to third parties in order to perform the service.
4. The license mentioned in point 2 is granted in the following areas:
a. In the scope of storing and multiplying of the Work,
b. In the scope of the turnover of the Work copies – marketing, loaning or renting the copies,
c. In the scope of spreading the Work in other ways – public execution, exhibiting, displaying, broadcasting and public sharing of the Work in such a way that everybody can have access to it in a chosen time and place.
5. The Advertiser is not entitled to remuneration for granting the license since the licence shall be executed with the sole purpose of performing the provided services to the Advertiser.

§ 10. Deleting Job Advertisement – Advertiser
1. The Job Board is entitled to delete a job advertisement or the Account from the website at any time on the grounds caused by the Advertiser and on the grounds not related to the Advertiser.
2. The Job Board reserves the right to reject the admission or publication of the job advertisement or the account creation on the grounds caused by the Advertiser.
3. The grounds caused by the Advertiser mean especially breaching the provisions of these Terms and Conditions or breaching the provisions of law through an improper content or form of the job advertisement or through a sole act or omission of the Advertiser.
4. In case of deleting a job advertisement or the Account on the grounds caused by the Advertiser the Job Board shall inform the Advertiser about the planned deletion of the job advertisement and advise them to stop the breaching at least 24 hours before deleting a job advertisement. The obligation to inform the Advertiser in advance before the planned deletion does not apply in the situation when the deletion of the job advertisement or the Profile aims at preventing a crime or eliminating the results of a crime or a misdemeanour.
5. The Advertiser is not entitled to any reimbursement if the job advertisement or the Account has been deleted on the grounds caused by the Advertiser, especially the Advertiser is not entitled to the reimbursement of the paid price in full or in part nor to any compensation.
6. If the job advertisement has been deleted on the grounds caused by the Job Board, the Advertiser shall receive a reimbursement of the price in the amount proportional to the period in which the job advertisement was not displayed. The payment shall be executed within 7 days from quoting an account number for reimbursement by the Advertiser.

§ 11. Candidate
1. A Candidate is a natural person that (i) expresses the willingness to be employed and submits a job application through the Job Board or (ii) creates account on the website.
2. A Candidate may conduct business activity.
3. The services of the Job Board are free of charge for the Candidate.
4. Receiving job applications from Candidates, forwarding job applications to Advertisers Is conducted in an automatic way. Should a technical issue occur, the Job Board shall continue trying to forward the application to the Advertiser (at least once in 24 hours) for 30 days. The Candidate shall be informed about unsuccessful submissions of their application.
5. The Job Board shall provide an error-free service, but makes no warranties or guarantees for the service provided apart from those specified in the law (art 471 and following of the Civil Code). All complaints regarding the provided services shall be presented to the Job Board in accordance with the procedure of making complaints specified in § 15 of these Terms and Conditions.
6. The Job Board does not have a code of good practices as defined in Art. 2 point 5 of the Act of August 23, 2007 on Prevention of Unfair Market Practices (Ustawa o przeciwdziałaniu nieuczciwym praktykom rynkowym).
7. The Candidate may communicate with the Job Board through the communication channels defined in § 1 point 5 of these Terms and Conditions. The Candidate may communicate with the Advertiser through the communication channels specified in a particular job advertisement, if such Job Board mentioned them.
8. The Candidate may use the following extrajudicial methods of examining the complaints and claims:
a. The Candidate may address the arbitration court acting at the Commercial Inspection (Inspekcja Handlowa) with a request of the resolution of the dispute,
b. The Candidate may address the regional inspector of the Commercial Inspection with a request of initiating mediation proceedings aimed at reaching an amicable settlement of the dispute between the Candidate and the Job Board,
c. The Candidate may receive a free of charge help in the matter of settlement of the dispute between the Candidate and the Job Board from the regional (municipal) consumer rights adviser or a social organization that deals with consumer rights protection (such as: Consument Federation (Federacja Konsumentów) or Association of Polish Consumers (Stowarzyszenie Konsumentów Polskich).

§ 12. Rights and Obligations of the Candidate Account
1. The account can be created by every natural person. The Candidate can own only one account with a given email address. Creating, keeping and deleting account is free of charge.
2. The account can be created through filling out and submitting the on-line Registration Form.
3. Logging in to the account takes place by means of authorization through login (e-mail from registration on-line form) and password.
4. Through the account one can: automatically fill out the job Profile and submit the job applications to the Job Board.
5. Automatic submitting job applications is possible after filling out the job Profile form by the Candidate. The Candidate can resign from this service any moment through deleting their data from the Profile form (deleting the form).
6. The Candidate can resign from the account at any moment by sending an email to the address specified in § 1 point. 5 of the Terms and Conditions. Deleting the account will take place in 72 working hours after receiving and reading the email.
7. Deleting the account has no influence on the job applications submitted by the Candidate.
8. The Job Board can delete the account if the Candidate does not log in during the period of 3 years. The Job Board will inform the Candidate about planning to delete the account 14 days beforehand via email.
9. The Job Board can delete the account if the Candidate violates these Terms and Conditions. The Job Board will call the Candidate to stop violating the Terms and Conditions or the law via email no later than 3 days before deleting the account.

§ 13. Rights and Obligations of the Candidate
1. The application shall be prepared in English or in Polish.
2. Information in the job Profile shall be complete, real, proper non-discriminating and not misleading. It is forbidden to post job applications of a sexual character.
3. A job application shall include a real reply to the job advertisement. It is forbidden to submit false job applications.
4. A job application may not aim at breaching the law, especially a job application may not aim at receiving information form the Advertiser in an illegal way.
5. A Candidate may be obliged to quote the following information in the job application:
a. name (s), surname,
b. parents’ names,
c. date of birth,
d. address (address for mailing),
e. education,
f. professional experience,
g. other personal data, if revealing them is necessary because of making use of special rights defined in the employment legislation,
h. PESEL number.
6. Shall a job advertisement require quoting other information than specified in point 5 in a direct on indirect way, we kindly ask you to inform the Job Board.
7. A Candidate is not obliged to include the following information in the job application:
a. racial or ethnic ancestry,
b. political, religious or philosophical views,
c. religious or political belonging,
d. state of health, genetic code, addictions or sexual life.
8. Shall a job advertisement require quoting such information in a direct on indirect way, we kindly ask you to inform the Job Board.
9. Provisions concerning a job application are applied directly to the Profile form unless otherwise provided by the Terms and Conditions.

§ 14. Scope of Responsibility
1. The Job Board is not responsible for the content of the job advertisements published by the Advertiser or the Profiles. The Job Board does not interfere in the content of job advertisements or the Profiles.
2. Filling out improper or non-complete identifying details by the Advertiser may cause lack of realisation or improper realisation of the ordered services, for which the Job Board does not bear responsibility.
3. The Job Board does not guarantee that the Advertiser will receive any applications or that the Advertiser will employ anybody for the position presented in the job advertisement. The Job Board neither guarantees that the job applications will be real nor their economic value for the Advertiser.
4. The Job Board neither guarantees that the Advertiser will contact the Candidate nor that the Candidate will be offered a job.
5. After forwarding the job application to the Advertiser the Job Board does not take part in the contacts between the Advertiser and the Candidate and shall not be responsible for such.
6 .The Job Board is provided on an “as is” basis which means it is available in the latest version that may be not error-free. There is no better alternative version. For this reason the Job Board makes no warranties about the provided services including the guarantee of quality.
7. The Job Board does not guarantee that the Job Board servers are free of viruses or other harmful software and for this reason is not responsible for any damage caused by computer viruses or harmful software.
8. The Job Board does not guarantee that the website content including the content of job advertisements and the Profiles will be error-free; especially free of inactive links, inadequacies or spelling errors.
9. The liability of the Job Board towards the Advertiser and Candidate, is limited to the amount of 400 PLN for all the damage cost by act or omission in a given calendar year. The Services is not responsible for the lost benefits.
10. The above limitations of liability do not apply to damages caused by wilful misconduct.
11. The Advertiser and Candidate are obliged to repair the damage caused to the Job Board in relation with the content of the published job advertisement or submitted job application including bearing the costs necessary of legal actions, judicial entries, legal representation costs and other justified expenses of the Job Board related to the claims of third persons or Advertisers and Candidates
12. The Job Board reserves the right to temporarily cease providing the services if providing services is not possible due to a fortuitous event such us fire, flooding, war or strike.
13. The Job Board reserves the right to a sporadic discontinuity of the provided services due to technical works in the scope of max. 24 hours per a year quarter.

§ 15. Security and Liability
1. The Job Board recommends using legal software including antivirus software in order to guarantee security while using the Job Board’s services.
2. It is forbidden to send information or contents of illegal, insulting, misleading character or contents including viruses or harmful mechanisms to the Job Board, Advertiser or Candidate.
3. The Job Board declares that in order to provide services it uses hosting services of a third person with whom it concluded an SLA agreement. Server settings are optimised to minimize possible discontinuity of the service.

§ 16. Technical Requirements
1. The Advertiser and Candidate must fulfil the following technical requirements to make use of the provided services:
a. having internet access,
b. having www browser: Firefox, Opera, Chrome Safari, IE or any other browser serving HTML5 or Android OS, IOS serving HTML5,
c. possessing an email account.
2. Third persons interested in viewing the content of job advertisements must fulfil the following technical requirements:
a. having internet access,
b. having www browser: Firefox, Opera, Chrome Safari, IE or any other browser serving HTML5 or Android OS, IOS serving HTML5.
3. The Job Board states that it may be necessary to turn on a Java, Javascript, Adobe Flash, XML, DHTML service and the manual transmission encryption SLL protocol in the browser in order to make use of all functionalities of the Job Board.

§ 17. Complaints
1. The Advertiser, Candidate and third persons may make a complaint at any time. A complaint may be related to the incompatibility of the service provided with the service obtained, breaching these Terms and Conditions, breaching the rights of the Advertiser, Candidate or third persons as defined in the provisions of law.
2. In case of the incompatibility of the service provided with the service obtained the Advertiser may demand repairing the incompatibility, decreasing the price, cancelling the agreement or paying the compensation, if a loss resulted from the incompatibility. It is assumed that the timeframe of the inconsistency was not longer than 7 working days from the date of making a complaint, if the Advertiser does not prove otherwise.
3. In case of breaching the rights of the Advertiser, Candidate or third persons defined in these Terms and Conditions or in the provisions of law, the Advertiser may demand repairing the incompatibility, cancelling the agreement or paying the compensation, if a loss resulted form breaching the laws whereas the Candidate and a third person may demand repairing the inconsistencies, paying the compensation, if a loss resulted form breaching the laws.
4. A complaint may be submitted in a written form to the address specified in § 1 point 5 or in an email format to the address specified in § 1 point 5.
5. Every complaint shall include:
a. Depending on the type of the claim some or all of the following identifying details:
● Advertiser’s company name and the number of the published job advertisements,
● Candidate’s name and surname and the number of the submitted job application,
● Name and surname of a third person.
b. email address,
c. description of the incompatibility of the service provided with the service obtained or breaching the rights of the Advertiser, Candidate or a third person as defined in these Terms and Conditions or any other reason for complaint,
d. the way of dealing with the complaint suggested by the Advertiser, Candidate or a third person,
e. specifying the loss if it took place.
6. The Job Board shall deal with the complaint within 21 days since the date of receiving a properly written application. The information on the complaint status shall be sent via email to the Advertiser’s, Candidate’s or third person’s mailbox irrespective of the decision. No response from the Job Board means the acceptance of the complaint with the exception of damage claims.
7. Shall the Job Board reserve a complaint in a negative way the Advertiser, Candidate or a third person may use other rightsapplicable in this case or take legal action against the Job Board.

§ 18. Trade Information
1. The Job Board sends a non-individuated trade information to the Advertisers and Candidates who have account and expressed their agreement to receive such. The trade information is related to the services provided by the Job Board, changes in the Job Board and new products that are planned. The trade information shall be sent out no more than every three months.
2. While registering Account on Job Board the Advertiser may agree to receive trade information to an email address given in the job advertisement or in the Profile. The email address given may not identify other natural person than the person submitting the job advertisement or in the Profile on behalf of the Advertiser.
3. The Advertiser and the Candidate may at any time without giving a reason withdraw their consent to receive trade information through sending an email to the email address specified in § 1 point 5 of these Terms and Conditions.
4. The agreement mentioned in points 2-3 means an agreement to receive trade information as per art. 172 point 1 of the Act of July 16, 2004, Telecommunication Law (Prawo Telekomunikacyjne) and art. 10 point 2 of the Act of July 18, 2002 on Rendering Electronic Services (Ustawa o świadczeniu usług drogą elektroniczą).
5. The Advertiser agrees to the distribution by the Service for marketing purposes of information on the use of the services of the Service (hereinafter: reference) during the period of using these services and for a period of 10 years after the end of using these services. The reference shall include the particulars of the Advertiser and his company or trade name, with a graphic and verbal mark in accordance with § 8 section 2 et seq.
6. Dissemination of information on the use of the services shall consist in placing information in the Service or in paper and electronic publications (including commercial offers) on one or more occasions.
7. The Advertiser agrees that his or her reference may be placed in the Service or in publications directly next to those of other entities and in the order chosen by the Service.
8. The Advertiser may, with the consent of the Service, supplement the reference with an entry concerning his use of the Service. The reference may also be supplemented by a separate reference, if the Service so decides and it may be supplemented by the Service with the company name, trade name and graphic and verbal mark of the Advertiser.
9. The reference shall be removed from the Service within 30 working days from the submission by the Advertiser in writing of a reasoned objection to the reference.

§ 19. Copyrights of the Job Board
1. The layout of the Job Board and the form of published contents is under copyright protection.
2. All rights to content including its graphic elements, choice and the layout of pages and other elements of the website are reserved unless clearly specified otherwise.
3. The Advertiser, Candidate or a third person are not entitled to copy, modify, reproduce, distribute or download in full or in part the content od the Job Board, unless clearly specified otherwise. This provision does not relate to copying the job advertisement for private use.

§ 20. Temporary Provisions
1. Provisions related to the Advertisers Account come into effect on June 26, 2019.

§ 21. Final Provisions
1. The Job Board reserves the right to edit these Terms and Conditions including the scope and price of the service. Shall these Terms and Conditions be changed, the new version shall be published on the website www.pmvalley.com. The new version of these Terms and Conditions applies to the services that have been ordered or commenced after publishing the amendments to these Terms and Conditions.
2. The Job Board reserves the right to publish advertising contents on the website www.pmvalley.com .
3. The Job Board operates under the Polish law and all issues related to using the service and Advertiser’s Account are subject to the provisions of the Polish law.
4. These Terms and Conditions have been prepared in Polish and English. In case of discrepancies the Polish version shall prevail.
5. The Polish court having jurisdiction over the Job Board’s seat shall investigate any disputes arising out of or in connection with these Terms and Conditions and of providing the services by the Job Board.

§ 2 Additional Offer
1. The price of the refreshment of the job advertisement as specified in § 5 point 4 is 125 PLN net/ 40 USD net.

§ 3 Price of the Account and Profile
1. The Account created on Job Board is free of charge, however, activating all available functionalities of the Account is possible only after the Advertiser has purchased the Standard Plus or Mega Package Offer, in pacticular:
a) active history od Advertiser’s orders on the Job Board (visible in the Advertiser’s Account) from the moment of one-time purchase of the Standard Plus or Mega Package Offer until closing the Account,
b) access to the full content of the Profiles of Candidates throughout duration of job advertisement publication.
